Welcome to MigraineMend (migrainemend.com), operated by MigraineMend (“we,” “us,” “our”). By accessing the site or placing an order, you agree to these Terms. If you do not agree, do not use the site.

Who we are

MigraineMend is a direct-to-consumer ecommerce brand. We sell physical products (including a migraine blackout eye mask and non-prescription FL-41 tinted glasses). We are not a medical clinic, do not provide medical advice, and are not affiliated with MEND Migraine / Dr. Brian Bakke at mendmigraine.com or other unrelated “Mend” health brands.

Eligibility

You must be able to form a binding contract in your jurisdiction to purchase. You agree that information you provide at checkout is accurate.

Products & descriptions

We try to describe products accurately (colors, materials, intended use). Colors may vary by screen. We reserve the right to correct pricing or description errors and to cancel orders when necessary.

Health disclaimer: Our products are wellness / light-management accessories. They are not FDA-approved medical devices (unless a specific claim is later legally established and stated), and they are not intended to diagnose, treat, cure, or prevent migraine or any other condition. Always consult a qualified healthcare professional for medical concerns. Individual results vary.

Pricing & payment

Prices are shown in the currency selected at checkout. Taxes may apply. Payment is processed via Shopify and its payment partners (including Shop Pay and supported wallets). You authorize charges for your order total.

Shipping & returns

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy (30-day window on eligible items; free shipping claims as advertised at checkout). Those policies are incorporated into these Terms.

Intellectual property

Site content, branding, logos, and product imagery are owned by MigraineMend or licensed to us. You may not copy or reuse them for commercial purposes without written permission.

User content & reviews

If you submit reviews, photos, or other content, you grant us a non-exclusive license to use that content for marketing and product display. Do not submit unlawful, infringing, or deceptive content. We may remove content at our discretion. Reviews should reflect genuine experiences.

Prohibited use

You may not misuse the site (scraping that harms service, fraud, chargeback abuse, malware, or unauthorized access). We may refuse service or cancel orders that appear fraudulent.

Limitation of liability

To the fullest extent permitted by law, MigraineMend is not liable for indirect, incidental, or consequential damages arising from use of the site or products. Our total liability for any claim related to an order is limited to the amount you paid for that order.

Indemnity

You agree to indemnify MigraineMend against claims arising from your misuse of the site, violation of these Terms, or infringement of others’ rights—except to the extent caused by our willful misconduct.

Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, except where consumer-protection laws in your place of residence require otherwise.

Changes

We may update these Terms by posting a new version on this page with an updated date. Continued use after changes constitutes acceptance where permitted by law.
